Implementation of the 2010 Florida Building Code
The latest assigned implementation date for the 2010 Florida Building Code and other associated codes is March 15, 2012. All permits applied for on or after March 15, 2012 must adhere to the new code.

Keep Your Home Safe
To help Floridians identify how they can strengthen their homes against hurricanes and to reduce hurricane damage exposure in our state, the My Safe Florida Home program is offering free wind inspections by qualified hurricane mitigation inspectors to eligible homeowners.

Floridians whose homes have undergone wind certification and hurricane mitigation inspections approved by the Department of Financial Services may be eligible to apply for matching grants up to $5,000.

The My Safe Florida Home program is working with local governments and the Volunteer Florida Foundation to offer low-income homeowners an opportunity to strengthen their homes against natural disasters. For more information please visit www.mysafefloridahome.com.

Florida Homeowners' Construction Recovery Fund

The Florida Homeowners' Construction Recovery Fund is a fund of last resort that is available to a natural person who has suffered monetary damages by the financial mismanagement or misconduct of a contractor, and who has exhausted all other resources of payment. The Construction Industry Licensing Board makes the determination of eligibility for an award.

Important Facts You Need to Know
  • A permit is good for 6 months from the date of issuance. Additionally; it will remain active for 6 months from the date of each approved inspection.
  • All inspections listed on your permit placard MUST be requested.
  • If an approved inspection has not taken place within 6 months, the permit will expire, becoming null and void.
  • You may request an extension for your permit. A request for extension must come in written form PRIOR to the expiration of the permit. The extension must provide the status of the project, the projected timeline to completion and explain why the extension is necessary.
  • If the permit expires, a new permit must be obtained to complete the project. (the original permit will not be renewed – reopened)
  • The cost of the new permit will vary.
  • If the permit was obtained by a licensed contractor and the permit expires, the contractor will be brought before the Flagler County Contractor Review Board for action.
  • If the contractor fails to follow through on the action required by the Board, the property owner is ultimately responsible for ensuring a new permit is issued the required inspections are made.
  • The Building Department / Contractor Review Board does not enforce contracts between property owners and contractors. That is something the property owner must handle. It is a civil matter.
  • If the permit was obtained by the property owner, action will be taken by the Code Enforcement Board.
  • The Building Department only has the authority to enforce the Florida Building Code.
NOTICE - HURRICANE MITIGATION RETROFIT REQUIREMENTS FOR ROOF REPLACEMENT
The 2007 Florida Legislature established new requirements for retrofitting buildings undergoing alteration with direction these new requirements go into effect October 1, 2007. The Legislature also directed the Florida Building Commission to develop prescriptive techniques for the requirements.

Pulling Owner/Builder Permits is Risky Business
If you do not intend to do the work yourself and have been asked by someone without a contractor's license to pull the permit, you are at risk of harm both by penalty and injury.

Chapter 489.103(7), Florida Statutes: Owners of property must supervise the work being performed. Any person working on your building who is not licensed must be employed by you, which means that you must deduct F.I.C.A. and withholding tax and provide workers' compensation for that employee.

Without workers' compensation insurance, you could be held liable for injuries received on your property. Typically, your homeowners' insurance policy will not honor your claim if the work being performed required a licensed contractor. You could end up responsible for thousands of dollars of medical bills.

Not only is it dangerous, but it's also a crime.

Chapter 455.227, Florida Statues: Any person who knowingly aides, assists, procures, employs or advises an unlicensed individual can be charged with a first degree misdemeanor and may face fines of up to $5,000 for each offence.
CONTRACTOR REGISTRATION
Before you can make application for a permit, you must first register with the Building Department. This is also true for any sub-contractors you use.

The Building Division offers a code assessment plan review for anyone wishing to have a plans examiner do a review to see if it meets the current Building Code. This review is not associated with a permit nor are any of the fees credited to a future permit. See the Code Assessment Application and Process document below for more information.
